Links of the Day
Posted by Frank J. at 08:40 AM | View blog reactions | Comments (28)

Rachel Lucas now has merchandise, and the result is both cute and right-wing.

Oscar Jr. has insulted me and tried to outdo my scientific survey of bloggers' ages (mine still has more digits). The official stance of IMAO is that we (meaning me) hate him. I have added a him to my blogroll so I can later de-link him (the ultimate insult to a blogger).

Tiffany has found a really short and silly libertarian quiz. Take it; it's fun!

That Rumsfeld-strangling-reporter mug you speculated about there, or perhaps one featuring the leg-breaking sledgehammer, would certainly brighten my mornings.

Be careful with delinking. It's the 'sphere's most deadly WMD.

#2 - Posted by: Joshua Martin on February 4, 2003 06:08 PM

And I second the idea of a Rumsfeld mug. I would at least think about the possibility of considering whether I might at some point purchase one. Provided they were cheap.

#3 - Posted by: Joshua Martin on February 4, 2003 06:10 PM

Can I use someone else's image for profit, though? Anyone know the legality of that?

#4 - Posted by: Frank J. on February 4, 2003 06:28 PM

A photo might be a problem, but a caricature would be OK, no?

#5 - Posted by: Ed Flinn on February 4, 2003 10:42 PM

Agreed: you're definitely on more solid ground with a caricature of a public figure. As long as it's reasonably clear that it isn't meant to be an accurate depiction, parody is protected by the First Amendment.

Photos could be more of a problem; this is not because Rummy himself could sue you for violating his copyright on his image, since every time he does a press conference he's holding it out to public, but because whoever took the picture holds a copyright on that. Hence, fair use means you can probably post or distribute it yourself for free, but using it for profit might get you in trouble.

Frank J.:

I'll probably be "insulting" you on my site again tonight, so be forewarned. It's only because I admire your writing so much...

David J. wrote, "fair use means you can probably post or distribute it yourself for free, but using it for profit might get you in trouble." I'm sure your characterization of this is correct, but I like to think that Rumsfeld would really enjoy this idea. Heck, I bet he'd buy one.

#7 - Posted by: Oscar Jr. on February 5, 2003 12:43 AM

Oscar,

I honestly don't doubt he would. AS I said, however, the party with standing to sue would be the media outlet that took the picture, and that's why a caricature would be much safer.

#8 - Posted by: David Jaroslav on February 5, 2003 10:31 PM

David:

You did say that, and quite clearly.

I think I misread Frank J.'s comment,
>Can I use someone else's image for profit,
>though? Anyone know the legality of that?
as concern that Rumsfeld might sue.

I now don't think he was asking *that* question, and I knew you weren't answering it.

Gee, I dunno! I have thought about this issue and its hard to get clarity. I, therefore, have to say I am totally undecided and it is nagging away like worrying about an early pregnancy test.
