MSNBC’s Brian Shactman asked a Democratic Congresswoman on supporting Obamacare, “what are we doing to get that message out there a little more?”

Well, going on MSNBC to get the word out – that’s about as little as it gets.

    Shactman’s wikipedia page lists him as a journalist, and the show he hosts is listed as a news show, and yet he phrases his question “what are we doing”. Journalism is surely dead.

    Equal time “rule”:

    “If any licensee shall permit any person who is a legally qualified candidate for any political office to use a broadcasting station, he shall afford equal opportunities to all other such candidates for that office in the use of such broadcasting station.

    In 1959, Congress amended the Communications Act after the FCC ruled that Chicago broadcasters had to give “equal time” to mayoral candidate Lar Daly; the incumbent mayor was then Richard Daley. In response, Congress created four exemptions to the equal time rule:

    (1) regularly scheduled newscasts
    (2) news interviews shows
    (3) documentaries (unless the documentary is about a candidate)
    (4) on-the-spot news events”

    It seems that the propaganda arm of the Democratic Party is in violation of said rule simply by existing as all of it’s “news” people are simply “obama Opinion ho’s” because none of what they do is news, on the spot or documentaries. Actually I’m not sure the slavering heads at MSNBC could find a news spot with both hands, a pack of St Bernards, a mob of sherpa and the Tardis. And yes I know the rule is about individual politicians but since the coverage there is all obama all the time I think is should apply.

    The Fairness Doctrine:

    In 1969, the U.S. Supreme Court unanimously (8-0) ruled that Red Lion Broadcasting Co. (of Red Lion, PA) had violated the fairness doctrine. Red Lion’s radio station, WGCB, aired a program that attacked an author and journalist, Fred J. Cook. Cook requested “equal time” but was refused; the FCC supported his claim because the agency viewed the WGCB program as a personal attack. The broadcaster appealed; the Supreme Court ruled for the plaintiff, Cook.

    In that ruling, the Court position the First Amendment as being “paramount,” but not to the broadcaster but to the “viewing and listening public.” Justice Byron White, writing for the Majority:

    “The Federal Communications Commission has for many years imposed on radio and television broadcasters the requirement that discussion of public issues be presented on broadcast stations, and that each side of those issues must be given fair coverage. This is known as the fairness doctrine, which originated very early in the history of broadcasting and has maintained its present outlines for some time. It is an obligation whose content has been defined in a long series of FCC rulings in particular cases, and which is distinct from the statutory [370] requirement of 315 of the Communications Act [note 1] that equal time be allotted all qualified candidates for public office…”

    If we read further we find that the plaintiff was a left wing author with a book about Barry Goldwater called Extremist on the Right. Apparently even then the courts concerned about the ” First Amendment as being “paramount,” but not to the broadcaster but to the “viewing and listening public.”. While the broadcasters at the time leaned right the courts were concerned about airing apposing views . However today it seems that opposing views to “progressivism , fascism, socialism and the imperial presidency are not a danger to the Fairness Doctrine. Apparently today our leftist counter parts also don’t like the idea that their hypocrisy is so easily discovered. Took me longer to write about it and just two clicks of the mouse to find it. No wonder they want to control the internet. Makes perfect sense to me.

    The Fairness Doctrine was repealed during the Reagan administration. It is what allowed hosts like Rush Limbaugh to gain prominence because there was no further concern on the part of broadcasters that they would be attacked by the FCC for allowing political opinions to be aired and not providing equal hours of basically free time to opposing viewpoints. The left has, on occasion, expressed an interest in reviving that doctrine but it seems to have died down over the past few years, at least I don’t remember hearing any discussion of it since the Clinton administration.
