Already done, my friend, except it was an international organization called COSPAR (the Committee on Space Research) which declared Mars’ water off-limits, not the EPA. The USA is party to an international treaty prohibiting the exploration of “Special Regions” where life might exist (such as areas with liquid water), to prevent contamination with earth microbes (which happen to be really, really, really hard to remove from equipment without doing things which destroy the equipment).
