Former FBI attorney Kevin Clinesmith, who falsified a document in the 2016 investigation into Russian interference in the presidential election, is seeking to avoid prison time.

Clinesmith’s attorneys filed a 48-page sentencing memorandum on Thursday, USA Today reports, in which they are asking for him to be sentenced to probation. The former lawyer acknowledged he committed a crime but did not intend to mislead investigators.

“Kevin Clinesmith made a grievous mistake,” his attorneys wrote, according to USA Today. “By altering a colleague’s email, he cut a corner in a job that required far better of him. He failed to live up to the FBI’s and his own high standards of conduct.”

  1. I robbed that bank but…I didn’t intend to keep the money. I shot that man…but I didn’t intend to harm him. I stole that car…but I didn’t intend to keep it. I broke into that house…but I didn’t intend to steal anything from it. I had a pound of weed in my possession…but I didn’t intend to smoke any of it. I drank a quart of bourbon…but I didn’t intend to get drunk. I beat my wife…but I didn’t intend to hurt her. Nice damn defense if you can get away with it. As far as his own high standards of conduct goes…sounds like lawyer BS to me.

  2. As reminders:

An email from the other government agency’s {CIA’s} liaison was sent to {FBI laywer} Clinesmith, who then “altered the liaison’s email by inserting the words ‘not a source’ into it, thus making it appear that the liaison had said that Page was ‘not a source‘ for the other agency” and sent it to “Supervisory Special Agent 2,” Horowitz found.
“Relying upon this altered email, [Clinesmith] signed the third renewal application that again failed to disclose Page’s past relationship with the other agency,” Horowitz wrote.

“Later, he himself was so concerned about his role in framing the Trump campaign that he wrote fretful text messages: “I am so stressed about what I could have done differently,” he sighed. “Plus, my g** damned name is all over the legal documents investigating [Trump’s] staff.”

“It’s beyond doubt that Clinesmith longed to see Trump toppled: In a Nov. 22, 2016, text message discussion about Trump, Clinesmith cheered: “Viva le Resistance!”

It’s perhaps telling that he lower-cased the name of the Deity in the second email.
