If you can say a penalty is a tax instead, and that’s really what the lawmakers meant when they wrote the word “penalty” — and that they meant an insurance exchange set up by a “state” was actually an exchange set up by the federal government — well, you aren’t just playing partisan political games anymore. Nope. You’re in the bigs.
