The problem with that logic is that –per the U.S. Tax Code and backed up by countless prior U.S. Tax Court rulings– a tax must be applied first before a penalty can be assessed. If Pelosi and the Democrats’ “penalty not a tax” argument were valid, then non-monetary penalties could be applied by the IRS to compel citizens to carry health insurance, such as the seizure of assets and property.
