Proportional

So the Supreme Court banned the death penalty as punishment for child rape, Justice Kennedy saying, “the death penalty is not a proportional punishment for the rape of a child.” So, I guess that means Kennedy wants child rapists child raped, i.e., give them brain surgery altering their mental state to that of a child and then rape them. What a sick bastard.
Anyway, the Supreme Court better hand down the right decision on Heller today or they should all be punished with child rape.

  1. I’m all for the proportionate response that the supremes are indicating, however, most of what criminals do to their victims would fall under “cruel and unusual punishment” according to the courts.
In a perfect world, child rapists would regret being born.

  2. Hold on a minute here, I assert that the Supreme Court is only wrong because they did not go far enough.
Of course it is WRONG for the state to MURDER someone by lethal injection for a crime that did not kill anyone. However, I am OUTRAGED that they did not explicitly find that solitary confinement with its horrible psychological effects on the poor besotted child rapist is also clearly cruel and unusual punishment.
The only way justice could ever be served is to ensure that in ALL circumstances the child rapist get ALL of the rehabilitation options open to all prisoners, without regard to their specific crimes.
The only way to do this is to ensure that the child rapists serve EVERY MINUTE of their time in the general prison population.
So that their fellow prisoners can do what the state is unwilling to do –
Send the bastards to hell in little pieces.
    Preferably slowly and painfully.

  3. My husband has always told me that if anyone ever hurt our children, HE would go to jail (you can figure out why.) I don’t really think that’s a good idea, although I understand it of course.
I agree with Brian (especially his last 2 sentences).
I also do not believe for one second that someone who harms a child can EVER be trusted to return to the general population again. Not ever. I think we should have a one strike law. Too many of these guys hurt children, are let out, only to do it again.
If you are a parent, check out the megan’s law website someday. It is quite sobering. You can actually see pics of those who hurt children… living right in your neighborhood! You can also look at their records (which will make you want to cry as they have all committed heinous acts on children and yet are walking free to do it again).
So yeah, very slow and very painful would be good.

  4. Take him up in an airplane strapped to a chair.
At 10,000 feet above an open field push him out.
If God wants him to live he’ll land soft.
If the hippies who want to ban executions want to interfere, let them stand in the field and try to catch him.
If he still dies, no one can say he didn’t have a fair chance.
And on the way down he’ll have plenty of time to Really repent!

  5. Maybe Kennedy’s really a badass, and he just wants the “system” to save child rapists for him, so he can personally pound the everloving f–k out of them, before turning them over to “federal pound-me-in-the-ass prison” for the rest of the justice.
Sorry for the crudeness… this is the type of response you should expect when discussing justice for child rapists.

  6. Two words:
    Rampant recidivism.
That’s what we get when we hope pedophiles just “get better”. BTW, they don’t.
Is that OK with everyone? That we just hope that the therapy works some of the time…
Sorry: This is why I’ll go to jail for one of those awful gun crimes we hear about.
    Heh. Gladly.

  7. If you’re looking for tenderly worded support for paedophiles’ “right” to humane treatment, then this is not your forum. Move along.
I agree that death isn’t a proportional response to this sort of perversion: there is no proportional punishment available to us on Earth. Death is merely our most efficient means of enabling the paedo’s entry into Hell, where the real punishment will begin. Kind of like transporting prisoners from court to jail, but with a really nasty shock at the end of the bus ride.
And, trite as it may sound, mark me down in the category of “Men who will see to it that any paedophile that touches their child will be healed. Permanently.” Mrs Dave knows what kind of cookies I like and has agreed to extend my magazine subscriptions for as long as I’m in prison.

  8. #7 and #12. My wife and I were never blessed with children.
    We’ve got less to loose.
If your children are victimized and you get the opportunity for retribution, Pin the rap on me!
I’ll deny all knowledge of it but I’ll act so guilty that it’ll muddy the waters until the police will never get a conviction!
    No, who am I kidding?
I’ve watched too many episodes of Law and Order to believe that that senerio has a chance of working!
Also, the subject is too serious for frivolity.
Being thrown into the sea with a millstone tied around ones’ neck is the only adequate punishment for such a monstrous act.
Proportionality as seen by justice Kennedy might mean that a painless death by lethal injection is too inadequate a punishment.
#5, Brian the Adequate has the right idea.
Since this Louisiana child rapists’ death penalty has been overturned, it doesn’t mean he’ll be set free.
(God! I hope it doesn’t mean that!).
It means he must be re-sentenced, and that means a certain term in general population of a particular prison, not in the comfy and secure solitary confinement of a death row cell.
    Justice may be served yet.
All we need do is wait.
