actually this is exactly what needs to happen.
A judge finds himself in a position where he needs to tell a little girl “here, you shall not pray”. Any intelligent mammal should come to the conclusion that this situation requires the judge to remove his jurisdiction from the situation, and nothing else needs to happen. Government can not be in charge of schools, period. Nothing they require therefore has any jurisdiction there.
